TOURAFRIKA (PTY) LTD, registration number 2017/463036/07 (“tour operator”)

APPLICATION

  • The terms and conditions contained in this document shall apply to the safari/tour booking concluded between tour operator and the client.
  • All references in these terms and conditions to “client” shall include references to an agent of the client, with such changes as the context may require.

BOOKINGS

  • The tour operator reserves the right not to confirm the booking until the full amount set out in the invoice received by client is paid and has been received and all the relevant documentation has been signed and completed in full by the client.
  • Any amendments to, or cancellation of the booking shall be subject to these terms and conditions defined herein.

CANCELLATION CONDITIONS

If the reservation is cancelled, cancellation fees will be due and payable according to the following:

  • More than 45 days prior to arrival – 90% refund of the total tour/safari price
  • 30 to 45 days prior to arrival – 80% refund of total tour/safari price
  • 15 to 30 days prior to arrival – 50% refund of total tour/safari price
  • Less than 15 days prior to arrival – no refund.All cancellations need to be made in writing and confirmed by the Reservations Team by email. The above-mentioned cancellation fees are applicable to any pre-booked or pre-paid Activity Packages which will also be charged if a safari/tour is cancelled.

ROUTE & ACCOMMODATION ALTERATIONS

        • The tour operator takes every care to ensure that itineraries are followed through to the letter, but unforeseen circumstances may necessitate changes. The tour operator accepts no liability due to the alteration of routes or substitution of properties. Where properties are substituted, they will be substituted for equal value.

CHILD POLICY

      • Bookings on our guided overland tours are strictly subject to the availability of child- friendly accommodation at the time of request.
        • Children 12 years and under pay only 50% of the tour price provided they are accompanied by an adult on day tours.
        • Children 12 years and under pay only 50% of the tour price provided they are accompanied by and share the same room with two full paying adults. Restrictions apply to certain tours.
        • As a courteous company, tour operator is able to provide child seats when required, however, we do advise that guests supply their own seats for children and infants. The tour operator cannot be held responsible should the seats provided not be suitable for the guests’

AGE RESTRICTION ACTIVITIES

      • Children under the age of 12 years are not permitted in the Serengeti.
      • The minimum required age for children to participate in any activity offered in Namibia, Botswana and Zimbabwe is the age of 12 years.
      • Children under the age of 12 are not permitted on:
        • SANParks Busk Walks
        • Nkambeni Bush Walks
        • South Luangwa Walking Safaris
      • Children under the age of 13 are not permitted on morning walks in Swaziland.
        • Due to our alcohol laws in South Africa – Children under the age of 18 are not permitted to partake in activities involving wine tasting.

PASSPORTS, VISAS & OTHER TRAVEL PAPERS

        • It is the client’s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations and any other required documentation are all in order for the countries to be visited during the tour.

PRIVACY POLICY

        • The tour operator Privacy Policy is detailed here.

LIABILITY

      • The tour operator shall not be liable for any damage, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots or any other cause outside tour operator control. The tour operator shall under no circumstances be considered as the agent of the passenger or of the supplier of any service.
      • The tour operator accepts no liability in respect of death, injury, loss or damage to person or property arising out of any act, omission or negligence of the tour operator, the supplier, the operator’s or supplier’s servants, save only in the case of wilful negligence or a wilful act or omission. The client shall be deemed to have waived, renounced and abandoned any and all right or entitlement, which the client may be entitled to under the provisions of the law of the Republic of South Africa for any loss or damage to person or property.
      • The tour operator shall not be liable for any loss or expense arising from the loss of property, cancellation or curtailment of the safari/tour however caused, save only to the extent that such loss of baggage, cancellation or curtailment was caused by our negligence. If sickness or accident interrupts a tour, the tour operator shall not be liable for any cost or expense arising there from, save only to the extent that such sickness or accident was caused by the tour operator’s wilful act or gross negligence. The tour operator shall not be liable for any refund, either total or partial, of passage money paid. The tour operator recommends passengers to take out the necessary insurance to protect the passengers against such eventuality.
        • The client shall be responsible for all baggage and personal effects brought by him or her on the safari/tour, and the tour operator shall not be liable for any loss or damage to such baggage or personal effects, howsoever arising.

PASSENGER RESPONSIBILITY

      • The client must at all times comply with the laws, customs and foreign exchange regulations of all countries visited during the safari/tour.
      • In addition, the client acknowledges that any disruptive, dangerous or potentially dangerous behaviour during the safari/tour shall not be tolerated and that the tour operator, its employees, representatives, agents and/or contractors being so authorized, reserve the right to exclude the client from the safari/tour at any point therein in such circumstances.
        • The tour operator shall not be liable for any costs and/or expenses for the client resulting from exclusion as aforesaid, and the client shall not be entitled to a refund or rebate of the tour price or any additional compensation in such instances.

FORCE MAJEURE

        • Unforeseen circumstances including but not limited to war, mechanical breakdowns, weather, riots and other unforeseen reasons beyond the control of tour operator may cause delays or alterations to the safari/tour. The tour operator shall not be held liable in any way for any of these possible occurrences or any consequences, which may arise as a result of these.
